RECOMMENDATION  NO.  LCR22604

SECTION 26(1), INDUSTRIAL RELATIONS ACT, 1990

PARTIES :
TOYOTA LOGISTICS SERVICE IRELAND (TLSIE)
(REPRESENTED BY IRISH BUSINESS AND EMPLOYERS' CONFEDERATION)

- AND -

20 GENERAL OPERATIVES
(REPRESENTED BY SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION)

DIVISION :

Chairman: Ms O'Donnell
Employer Member: Mr Marie
Worker Member: Mr Bell

SUBJECT:

1. Pay Claim and Annual Leave.

BACKGROUND:

2. This dispute could not be resolved at local level and was the subject of a Conciliation Conference under the auspices of the Workplace Relations Commission. As agreement was not reached, the dispute was referred to the Labour Court on the 7 February 2022 in accordance with Section 26(1) of the Industrial Relations Act, 1990.

RECOMMENDATION :

The issue in dispute between the parties arises from the Unions claim for a pay increase of 3% and two-days annual leave for the period 1st July 2021 to 30th June 2022. Local discussions took place in July 2021 and the Employer proposed a 2.5% pay increase for the period. This was balloted on and rejected by the SIPTU members in August 2021. A conciliation conference took place on 14th September 2021. Arising from that conciliation conference a proposal of a pay increase of 2.2% back date to 1st July 2021 and an increase of one day’s annual leave was put to ballot and rejected by the Union.

Further local discussions took place on the 28th October 2021. The Union maintained their claim for 3% and two-days annual leave. The Employer made a further offer of 2.2%, one day’s annual leave from 1/1/22 and .5 (half day) annual leave for 2021. The Employer stated if this was rejected any agreement at a future date would only be with effect from date of agreement.

A further conciliation conference was held on the 24th January 2022, as no progress could be made the parties agreed to a joint referral to the Court.

The Court having read the submissions of the parties and listened carefully to the oral submissions made on the day recommends as follows:

2.6% pay increase backdated to 1st July 2021.

Annual leave entitlement to be increased with effect from 1/1/22 from 23 to 24 days.

The Court notes that issues in respect of the ‘Kaizen Bonus’ were not part of this process and are being addressed separately. The Court also notes the commitment of the employer to commence further pay discussion for the year commencing July 2022.

Implementation of this recommendation should take place as soon as is practical after acceptance of same.

The Court so recommends.

Signed on behalf of the Labour Court
Louise O'Donnell
