SUBJECT:

1. Appeal of Adjudication Officer's Decision No. ADJ-00003893 CA-00005863-001

BACKGROUND:

2.
The Claimant appealed Adjudication Officer's Decision ADJ-00003893 to the Labour Court in accordance with Section 77(12) of the Employment Equality Acts, 1998 to 2015. A Labour Court hearing took place on 10 September 2020. The following is the Determination of the Court:

DETERMINATION :

This is an appeal by Denis Delaney (hereafter the Appellant) against an Adjudication Officer’s Decision given under the Employment Equality Acts, 1998 to 2015 (the Act), in a claim that he was discriminated against by his former employer, Grant Engineering (Ireland) Unlimited Company (hereafter the Respondent). The Adjudication Officer found that the complaint was not well founded.

The appeal was scheduled for hearing on Thursday 10th September 2020. The Court notified the Appellant’s representative and the Respondent’s representative by e-mail and post of the date and time of the hearing in August 2020. The addresses used in all cases were those which had been supplied to the Court by the parties and which had previously been the basis of correspondence with the parties in relation to the appeal. The Court is satisfied that both parties were properly and adequately notified of the date, time and place of the hearing of the within appeal.

The Respondent attended the hearing of the Court. Neither the Appellant nor his representative attended the hearing. As the Appellant was not present to move the appeal the appeal must fail. The Decision of the Adjudication Officer is affirmed.

The Court so Determines.

Signed on behalf of the Labour Court
Kevin Foley
