2. The Claimant appealed the decision of the Adjudication Officer to the Labour Court on the 14th February 2019. Labour Court hearings took place on the 21st November 2019 and 28th January 2020. The following is the Court's Determination:

DETERMINATION :

Background

This is an appeal by Mr. Jawornicki, ‘the Complainant’, of a Decision by an Adjudication Officer under the Employment Equality Acts 1977 to 2015. The Complainant made a complaint against Panelto Foods that he had been dismissed from his employment for reasons of race and gender. The Adjudication Officer had not upheld the complaint.

Deliberation

The Complainant failed to attend the Court hearing on the 28th January 2020. His appeal was not presented and, therefore, fails.

Determination

The Decision of the Adjudication Officer is upheld.

The Court so determines.
