BACKGROUND:

2. The Complainant appealed the Adjudication Officer's Decision to the Labour Court in accordance with Section 8A of the Unfair Dismissals Acts 1977 to 2015. A Labour Court hearing took place on 10 December 2019. The following is the Determination of the Court:


DETERMINATION :

This is an appeal by Gabriel Alexa (hereafter the Complainant) against an Adjudication Officer’s Decision ADJ-00007047 given under the Unfair Dismissals Act 1977 (the Act) in a claim that he was constructively dismissed by his former employer Hertz Rent A Car Ryan Investments (hereafter the Respondent). The Adjudication Officer found that the complaint was not well founded.

The case was scheduled for hearing on Tuesday 10th December 2019. The Respondent attended the hearing. The Complainant despite engaging with the Court in relation to the provision of an Interpreter a few days earlier did not attend the hearing. As the Complainant was not present to move the appeal the appeal must fail. The Decision of the Adjudication Officer stands.
