DIVISION :

Chairman: Mr Haugh
Employer Member: Ms Doyle
Worker Member: Mr McCarthy
SUBJECT:
1. Appeal Of Adjudication Officer Decision No. ADJ-00002537.

BACKGROUND:

2. The Worker appealed the Decision of the Adjudication Officer to the Labour Court in accordance with Section 9(1) of the Unfair Dismissals Act, 1977 to 2015 on 26 July 2017. A Labour Court hearing took place on 16 August 2019. The following is the Determination of the Court:

DETERMINATION :

Background to the Appeal

This is an appeal by Mr Radek Velicka (‘the Complainant’) from a decision of an Adjudication Officer (ADJ-00002537, dated 16 June 2017) under the Unfair Dismissals Act 1977 (‘the Act’). The Complainant’s Notice of Appeal was received by the Court on 26 July 2017. The Complainant lodged a written submission in support of his appeal on 17 August 2017. A written submission was received from OCS One Complete Solution Limited (‘the Respondent’) on 13 August 2019.

The Court sat to hear the appeal on 16 August 2019. The Respondent was in attendance and was represented by an official from IBEC. The Complainant, although duly notified by the Court of the hearing date and venue, did not attend at the appeal.

Decision

As the Complainant did not attend to prosecute his appeal, the Court determines that the appeal fails for want of prosecution.

The Court so determines.

Signed on behalf of the Labour Court

Alan Haugh
