BACKGROUND:

2. This matter was referred to an Adjudication Officer for investigation and Recommendation. On 29 April 2019 the Adjudication Officer issued her Recommendation.

The Employer appealed the Adjudication Officer’s Recommendation to the Labour Court on 13 June 2019 in accordance with Section 13(9) of the Industrial Relations Act, 1969.

A Labour Court hearing took place on 14 August 2019.



DECISION :

Determination

The appeal was received outside of the 42 days specified in the Act.

No reason to justify the failure to submit the appeal in time was put to the Court.

The Court determines that a valid appeal was not received within the prescribed time limits.
