BACKGROUND:

2. The Employer appealed the Decision of the Adjudication Officer to the Labour Court in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. A Labour Court hearing took place on 14 August 2019. The following is the Decision of the Court.


DETERMINATION :

Determination

The appeal was received outside of the 42 days specified in the Act.

No reason to justify the failure to submit the appeal in time was put to the Court.

The Court determines that a valid appeal was not received within the prescribed time limits.
