BACKGROUND:

2. The Court investigated the above dispute on the 16th of August, 2002. The following is the Court's Recommendation.

RECOMMENDATION:

In relation to both issues in dispute, the Court believes that the Company should make full details of its financial circumstances available to the Union, including the audited accounts. This should be subject to such conditions as to confidentiality as are appropriate.


Discussions should then resume between the parties on both issues. These discussions should continue for not more than 2 weeks from the date on which the financial information is provided. If agreement is not reached the matters outstanding may be referred back to the Court which will facilitate the parties with an early hearing.
