1. Clarification arising from LCR 15466.





BACKGROUND:

2. The Court met with both parties involved in the dispute heard on 10th February, 1997, in order to clarify its recommendation of 28th February, 1997.

The clarifications agreed with both parties are as below:-



RECOMMENDATION:

The former relief driver will be facilitated with one of the redundancy positions under the TOPS voluntary redundancy programme. A driver replacement has been selected and will be trained with a view to enabling the redundancy to be put in place by 31st October, 1997.

The remaining two drivers are not included for voluntary redundancy under the Labour Court Recommendation.

The Company will undertake some back-up training for key areas so as to prevent a situation


arising again where certain key workers would not be eligible to apply for any future redundancy programmes, even though having precedence under seniority. The number of back up personnel is an issue for the parties to discuss.
