Appeal of Adjudication Officer Decision No's: ADJ-00049427 (CA-00060643-001)

BACKGROUND:

The Worker appealed the Decision of the Adjudication Officerto the Labour Court on 12 July 2024 in accordance with Section 8A of the Unfair Dismissals Act 1977 to 2015.

A Labour Court hearing took place on 10 February 2026.

The following is the Decision of the Court: -

DECISION:

Background to the Appeal

 This is an appeal by Mr Singh (the Complainant) against Adjudication Officer’s Decision ADJ-00049427 CA-00060643-001 given under the Unfair Dismissals Acta 1977 to 2015 (the Act’s) in a claim against his previous employer Northside Travellers Support Clg (T/A Travact (the Respondent) that he was unfairly dismissed.  The Adjudication Officer upheld his complaint and awarded compensation of €8,500. There are linked cases PW/24/128, MN/24/13 and MN/24/14.

 On 21 January 2026 the Court received correspondence from a Mr Boland of Grant Thornton informing the Court that he had been appointed as Joint liquidator and confirming that as liquidators they had submitted a claim to the Department of Social Protection in respect of the awards made to the Complainant and the funds received were paid to the Complainant. The letter confirmed that they would not be attending the hearing.

 At the commencement of the hearing the Complainant confirmed to the Court that he had received and accepted the payments. The Court informed the Complainant that as he had accepted the awards made by the Adjudication Officer, he could not also proceed to appeal those decisions. On that basis the appeals fails.

 The decision of the Adjudication Officer is upheld.

 The Court so determines.
