Appeal of Adjudication Officer Decision No. IR-SC-00002375
BACKGROUND:
The Worker appealed the Adjudication Officer’s Recommendation to the Labour Court on 13 January 2025in accordance with Section 13(9) of the Industrial Relations Act, 1969.
On 13 December 2024 the Adjudication Officer issued the following Recommendation: “I do not recommend in favour of the Worker.’’
A Labour Court hearing took place on 11 March 2026.
DECISION:
The matter before the Court is a claim by the worker for application of the current top point of the City of Dublin Youth Worker salary scale as of February 2026, €57,581.
In a linked appeal under the Payment of Wages Act, 1991, the Worker contended that the employer had made an unlawful deduction from her wages - during the relevant period encompassed by that complaint - by failing to award her incremental pay increases. She contended that her salary for that relevant period September 2023 to March 2024 should have been €52,272, which was the top point of the scale during that period.
On the facts as presented in that linked Payment of Wages appeal, the Court found that the Complainant has failed to make out a case that she was entitled to be paid at the top point of the City of Dublin Youth Worker salary scale.
In light of the above and having regard to the submission made by both sides at the hearing, the Court can find no basis for recommending in the Worker’s favour.
The Court so recommends.
