Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 following the referral of the complaints to me by the Director General, I inquired into the complaints and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaints.
Background:
The Complainant commenced employment with the Respondent on 8th August 2022. The Complainant’s tenure with the Respondent was brief, with his contract being terminated on 23rd September 2022.
On 29th December 2022 and 1st January 2023, the Complainant referred the present complaints to the Commission. A hearing in relation to the same was duly convened for, and finalised on, 14th June 2023.
At the hearing of the matter there was no appearance by or on behalf of the Complainant. The Respondent submitted a full defense to the complaints and attended the hearing with the relevant witnesses in this regard. |
Summary of the Complainant’s Case:
As outlined above, the Complainant did not attend the hearing as scheduled. Having reviewed the file in this regard, it is apparent that the Complainant was aware of the time, date and venue of the hearing. In such circumstances, and in the absence of any adjournment application or explanation for the Complainant’s non-attendance, the matter proceeded in his absence. |
Summary of the Respondent’s Case:
The Respondent attended the hearing and confirmed that they were willing and prepared to dispute the Complainant’s allegations. |
Findings and Conclusions:
In circumstances whereby the Complainant did not attend the hearing to give evidence in support of his complaints, I find that the same are not well-founded. |
Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaints in accordance with the relevant redress provisions under Schedule 6 of that Act.
