This case came before the Tribunal by way of an employee appealing the decision of the Rights Commissioner under the Payment of Wages Act, 1991, the Terms of Employment (Information) Act, 1994 and 2001 and the Organisation of Working Time Act, 1991, references: r-128269-pw-12/JT, r-128276,128274,128276-te-12/JT and r-128270,128271-wt-12/JT.
The determination of the Tribunal was as follows:-
Background:
The appellant took three claims under the three named Acts to the Rights Commissioner. A hearing of these claims took place on the 18th February 2013. A written decision for all claims was signed and dated the 10th April 2013 and issued to all parties. The appellant appealed all three decisions to the Employment Appeals Tribunal on the 14th June 2013.
Determination:
The Tribunal are satisfied that the appellant was properly notified of the time, date and location of the hearing. He was not present of the day of the hearing to prosecute his appeals.
Accordingly, his appeals under the Payment of Wages Act, 1991, the Terms of Employment (Information) Acts, 1994 and 2001 and the Organisation of Working Time Act, 1191 are dismissed for failure to prosecute.
