1. Time Limit.






BACKGROUND:

2. The worker referred the dispute to the Labour Court on the 12th July, 1996, in accordance with Section 26(4) of the Employment Equality Act, 1977. A Labour Court hearing took place on the 20th February, 1997. The following is the Court's decision:





DECISION:

Having considered the evidence, the Court considers that the claimant's case that the time limits in the Act of 1977 were not breached is valid.



The Court, accordingly, will refer the claim for constructive dismissal for investigation.
